RESPONSIBLE FOR THE PROCESSING OF YOUR PERSONAL DATA

Personal data will be processed by MKG Interactive Services, with registered office at Shree Ganpati Knowledge Park, Sanskar Educational Group, NH09, Ghaziabad, Uttar Pradesh, hereinafter “MKG”.

LEGISLATION

The processing of users’ personal data carried out by MKG, as well as the sending of commercial communications carried out by electronic means, are in compliance with the national and community legislation in force.

PROCESSING OF PERSONAL DATA

The processing of personal data is carried out in accordance with the general principles:

  • In the context of the relationship established with the data subject, we ensure that personal data will be processed in a lawful, fair and transparent manner (“Principle of lawfulness, fairness and transparency”);
  • We collect personal data for specified, explicit and legitimate purposes and do not further process the same data in a manner incompatible with those purposes (“Principle of purpose limitation”);
  • We ensure that only adequate, relevant and limited personal data are processed to what is strictly necessary for the purposes for which they are processed (“Principle of data minimization”);
  • We take appropriate measures to ensure that inaccurate personal data, taking into account the purposes for which they are processed, are erased or rectified without delay (“Principle of accuracy”);
  • We retain personal data in a way that allows your identification only for the period necessary for the purposes for which they are processed (“Principle of retention”);
  • We ensure that personal data is processed in a manner that guarantees its security, including protection against unauthorized or unlawful processing and against accidental loss, destruction or damage, by adopting appropriate technical or organizational measures (“Principle of integrity and confidentiality”).
WHAT PERSONAL DATA DO WE PROCESS?

In the context of the activities carried out by MKG, the Data Subject is, without limitation, the customer and/or former customers, potential customers, partners, job applicants, employees and former employees, employees of partners, suppliers and service providers and their employees, visitors and individuals captured in images and photos of MKG events and all those individuals who maintain a relationship with MKG and to whom the Personal Data relates.

MKG does not voluntarily or directly request or collect personal data from minors. If MKG discovers that it has inadvertently collected personal data from a minor under the age of 18, it will immediately delete the records containing that minor’s personal data. We would like to point out, however, that MKG may collect personal data relating to minors when provided by their parents or legal guardian who expressly consents to such collection or when such data is collected through CCTV systems.

In carrying out its activities, MKG processes Personal Data of a significant number of categories of Data Subjects.

The Personal Data that MKG collects always depends on the nature of the interaction, but may include the following:

  • Personal and contact details: Name, surname, postal address, telephone or mobile number, email address or other similar contact information.
  • Commercial data for the provision of services and/or products, data related to the provision of services or supply of products, billing data, payment data and/or information in the context of responding to any questions, requests or complaints.
  • How you purchased or subscribed to products and/or services, your transaction, billing history and assistance in the context of the MKG services you use or any other related information.
  • Security Credentials Data: User IDs, passwords and similar security information required for authentication and access to MKG accounts
  • Demographic data: Country, gender, age, preferred language, general education and professional history, as well as general job interest data.
  • Preference Data: Information about the data subject’s preferences and interests, insofar as this is related to the products and/or services and how they prefer to receive communications.
  • Social media data: Information shared on social media when interacting with MKG, where transparency is guaranteed through the existence of appropriate privacy policies.
  • IT usage data of MKG employees: user ID, roles, rights, login times, computer name, IP address.
  • Data on the use of images and photos of individuals taken at MKG events

Please note that you are not required to share your personal data with MKG. However, if you choose not to share your personal information, in some cases, MKG may not be able to provide the services or products you request, provide certain specialized features, or effectively respond to any questions you may have.

WHY WE PROCESS YOUR INFORMATION

The development and performance of the various activities pursued by MKG, mean the existence of a relevant set of specific, explicit and legitimate purposes for the processing of your Personal Data, such as:

  • Customer and supplier management
  • Administrative management, financial management and accounting
  • Commercial Activity and Marketing
  • Control, Security and integrity of facilities and equipment
  • Contact Management
  • Compliance with Legal Obligations
  • Data Transfer to Third Parties
WHAT WE PROCESS YOUR INFORMATION FOR

MKG only processes personal data when there is a lawful basis that legitimizes the processing, namely:

  • Consent

    MKG will only process personal data if you consent to the respective Processing through a free, specific, informed and explicit manifestation of will, by which you accept, by means of a declaration (in writing or orally) or an unequivocal positive act (by filling in an option), that the personal data be subject to Processing.
  • Pre-contractual due diligence or the execution of a contract

    MKG may process personal data if they are necessary, without limitation, for the execution of a service provision and/or product supply contract to which it is a party as an Employee, Customer and/or Supplier, or to carry out pre-contractual steps at its request.
  • Compliance with a legal obligation

    MKG may process personal data to ensure and guarantee compliance with legal obligations to which it is subject under the legislation of a Member State and/or the European Union.
  • Legitimate Interests

    MKG, other Controllers or Third Parties may process personal data provided that such Processing does not prevail over your interests or fundamental rights and freedoms.
HOW LONG DO WE KEEP PERSONAL DATA?

MKG retains personal data only for the period necessary to fulfill the specific purposes for which it was collected. However, MKG may be required to retain some Personal Data for a longer period, taking into account factors such as:

  • Legal obligations, under applicable laws, to retain Personal Data for a certain period;
  • Prescription periods, under the laws in force;
  • (eventual) Disputes; and,
  • Guidelines issued by competent data protection authorities.

During the period of Processing of your Personal Data, MKG ensures that they are treated in accordance with this Data Protection and Privacy Policy. As soon as your Data is no longer necessary, MKG will proceed to delete it securely.

SHARING OF PERSONAL DATA

Personal data may be shared with companies responsible for providing MKG services.

The companies responsible for providing services are bound to MKG by written contract and may only process personal data for the specifically established purposes and are not authorized to process your Personal Data, directly or indirectly, for any other purpose, for their own benefit or that of a third party.

Personal data may be shared internally with other MKG companies that will comply with the applicable data protection rules depending on the purposes related to the Processing carried out.

At your request and with your consent, personal data may be shared with other entities.

In compliance with legal and/or contractual obligations, Personal Data may also be transmitted to judicial, administrative, supervisory or regulatory authorities and also to entities that lawfully carry out data compilation actions, fraud prevention and combat actions, market or statistical studies.

CROSS-BORDER TRANSFER

MKG may transfer personal data outside the country, to locations that may not guarantee the same level of protection.

However, MKG only transfers personal data outside:

  • Through binding corporate rules applicable to MKG companies;
  • Where the transfer is made to a location or through a method or in circumstances which ensures adequate protection of your Personal Data;
  • Where you have implemented standard data protection clauses adopted by a competent data protection authority; or,
  • When none of the above applies, but the law still authorizes such transfer, for example, if it is necessary for the declaration, exercise or defense of a right in legal proceedings.

WHAT ARE YOUR RIGHTS

As the Holder of Personal Data processed by MKG, you have the right to access, rectify, limit, transfer, erase and the right to object to the Processing of Personal Data, in certain circumstances, which may be exercised under the terms of this chapter of the Privacy Policy.

  • Right to information provision

    You have the right to obtain clear, transparent and easily understandable information about how MKG uses personal data and what your rights are. That is why MKG provides you with all this information in this Privacy Policy.
  • Right of access

    You have the right to obtain information about what Personal Data MKG processes (if any) and certain information (similar to that provided in this Privacy Policy) about how such Data is processed. This right allows you to know and confirm that we use your Data in compliance with data protection laws.

    MKG may refuse to provide the requested information whenever, in order to do so, MKG has to reveal Personal Data of another person or the information negatively impacts the rights of another person.
  • Right of rectification

    If your Data is incorrect or incomplete (for example, if your name or address is wrong), you can ask MKG to take reasonable steps to correct it.
  • Right to erasure of data

    This right is also known as the “right to be forgotten” and, simply put, allows you to request the erasure or deletion of your data, provided that there are no valid grounds for MKG to continue using it or its use is unlawful. It is not a generic right to erasure, as exceptions are allowed (for example, whenever such data is necessary to defend a right in a legal proceeding).
  • Right to restriction of processing

    You have the right to “block” or prevent future use of your Data while MKG evaluates a request for rectification or as an alternative to erasure. Where Processing is limited, MKG may continue to store your Data but will not be able to use it further. MKG keeps a list of data subjects who have requested “blocking” of future use of their Data to ensure that this limitation is respected.
  • Right to data portability

    You have the right to obtain and reuse certain Personal Data for your own purposes across multiple organizations. This right only applies to Personal Data that you have provided to MKG and that MKG processes with your consent and that is processed by automated means. 
  • Right to object

    You have the right to object to certain types of processing on grounds relating to your particular situation at any time when such processing is taking place for the purposes of the legitimate interests pursued by MKG or by Third Parties. MKG may continue to process such Data if it can demonstrate “overriding legitimate grounds for the Processing which override your interests, rights and freedoms” or if such Data is necessary for the establishment, exercise or defence of legal claims.
  • Right to lodge a complaint

    You have the right to lodge a complaint with the competent supervisory authority, if you consider that the Processing carried out on Personal Data violates your rights and/or applicable data protection laws.

SECURITY AND CONFIDENTIALITY

Personal data will be processed by MKG, in the context of the purposes identified in this Policy, in accordance with MKG’s internal policy and rules and using appropriate technical and organizational measures to promote their security and integrity, in particular in relation to unauthorized or unlawful processing of personal data and their accidental loss, destruction or damage.

Without limitation, MKG uses logical and physical security requirements and measures to ensure the protection of personal data by preventing unauthorized access, ensures that information is stored on secure computers in a closed and certified information center and that Data is encrypted whenever possible, implements audit and control procedures to ensure compliance with security and privacy policies and periodically reviews our security policies and procedures to ensure that MKG systems are safe and secure.

However, since the transmission of information via the Internet is not completely secure, MKG cannot guarantee the security of your Data when transmitted over an open network.

MKG acknowledges that the information you provide to us may be confidential. MKG does not sell, rent, distribute, or otherwise make available commercially or otherwise your Personal Data to any third party, except in cases where it needs to share information with Service Providers for the purposes set out in this Data Protection and Privacy Policy. MKG preserves the confidentiality and integrity of your Data and protects it in accordance with this Data Protection and Privacy Policy and all applicable laws.

MKG may periodically update this Data Protection and Privacy Policy, as well as any other specific data protection and privacy statements. When changes are made to this Data Protection and Privacy Policy, a new date will be added at the beginning of the Data Protection and Privacy Policy.
